Welcome to Tipsterland (hereinafter, the «Service» or the «Platform»). These general terms govern access to and use of the Tipsterland website and applications. Accessing or using the Service implies full acceptance of these terms; if you do not agree with them, you must not use the Service.
1. Purpose
Tipsterland is a social sports content platform that allows users («tipsters») to publish predictions or analysis on sporting events («picks»), and other users to follow, comment on and save them and, where applicable, subscribe to premium channels to access additional content from a tipster. Tipsterland does not organise, manage or take part in betting, is neither a bookmaker nor a betting broker, and does not intervene in the relationship between the user and any betting operator the user decides to use.
2. Use of the service
Access to certain features requires you to be over 18 and to have the legal capacity to enter into contracts; by registering you declare that you meet these requirements. You undertake to use the Service in accordance with the law, public morals, public order and these terms, and in particular not to: (a) publish unlawful, defamatory or fraudulent content, or content that infringes third-party rights; (b) manipulate or falsify statistics, results or the tipster ranking; (c) impersonate third parties; (d) use bots, scraping or other unauthorised automated means; (e) circumvent premium channel payments or resell access to third parties. Non-compliance may result in the suspension or closure of the account.
3. Registration and user accounts
To access social features (posting, commenting, following, subscribing) you must create an account with truthful, accurate and up-to-date information. You are responsible for keeping your credentials confidential and for all activity carried out from your account, and you must notify us immediately of any unauthorised use. Tipsterland allows you to sign in by email, single-use links or external providers (e.g. Google), subject to availability. Each person may keep a single active account, unless expressly authorised otherwise.
4. Tipster content and picks
The picks, predictions, statistics and analysis published by tipsters are purely informational and for entertainment. Under no circumstances do they constitute financial advice, an investment recommendation or a guarantee of results. Betting involves a real risk of financial loss; the decision to bet is free and exclusive to each user, under their own sole responsibility. The Service is intended exclusively for people aged 18 or over. Gamble responsibly: if you feel that gambling has stopped being entertainment, seek specialised professional help —for example, through the Spanish Federation of Rehabilitated Gamblers (FEJAR)— or request your self-exclusion in the General Register of Gambling Access Bans (RGIAJ), managed by the Spanish Directorate-General for the Regulation of Gambling.
Tipsters are responsible for the content they publish. Tipsterland may publicly display a tipster's results history for statistical and transparency purposes, without this implying any endorsement, recommendation or guarantee as to the reliability of their future predictions.
5. Payments, subscriptions and premium channels
Certain tipsters may offer paid premium channels, with prices expressed in euros (taxes included where applicable). Payments are processed through secure external payment gateways (e.g. Stripe) or other means enabled on the Platform (Tipsterland Bank balance); Tipsterland does not store your full card details. Subscriptions renew or expire according to the terms shown when you take them out, and you can cancel them at any time from your account, taking effect from the following period.
Refunds: given that access to a premium channel constitutes digital content supplied immediately after payment, by purchasing it you expressly accept that its performance begins during the withdrawal period and you waive that right, in accordance with Art. 103(m) of Spanish Royal Legislative Decree 1/2007 (Consolidated Text of the General Law for the Defence of Consumers and Users). Consequently, as a general rule no refunds are given for amounts already accrued, except in the cases required by applicable law (e.g. billing error, duplicate charge, fraud or failure to provide the contracted service), which will be handled case by case through support.
6. Intellectual and industrial property
The «Tipsterland» trademark, the logo, the design, the software and the other elements belonging to the Platform are owned by Tipsterland or its licensors and are protected by intellectual and industrial property law. Their reproduction, distribution or transformation without prior written authorisation is prohibited.
Users and tipsters retain ownership of the content they publish (picks, comments, images, posts). By publishing it, they grant Tipsterland a worldwide, non-exclusive and royalty-free licence to host, display, reproduce and distribute that content within the Platform and in its promotion, for as long as the content remains published.
7. Liability
Tipsterland provides the Service with reasonable diligence, but does not guarantee its uninterrupted availability or the accuracy, currency or reliability of content published by third parties (tipsters or other users). To the extent permitted by law, Tipsterland will not be liable for losses arising from betting decisions made on the basis of content on the Platform, nor for indirect damages arising from use of the Service. The Service may link to third-party sites (e.g. bookmakers) over whose content and terms Tipsterland has no control and assumes no responsibility.
8. Changes to these terms
We may update these terms to reflect legal or technical changes, or changes to the Service itself. We will publish the current version on this page together with its update date; substantial changes will be notified by reasonable means (e.g. an in-app notice or email). Continued use of the Service after the changes are published implies acceptance of them.
9. Governing law and jurisdiction
These terms are governed by Spanish law. For any dispute, the parties submit to the Courts and Tribunals of the user's domicile where the user is a consumer; otherwise, to the Courts and Tribunals of Tipsterland's registered office. European Union users who are consumers may additionally turn to the alternative/online consumer dispute resolution mechanisms available in their country.
